1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the NetSense NMS website at netsense-nms.comand the NetSense NMS cloud platform (collectively, the "Service"), operated by Extreme Labs, registered at 109 Todor Alexandrov Bvd, fl.9, Sofia 1303, Bulgaria.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
NetSense NMS is a cloud-based (SaaS) network monitoring platform designed for Internet Service Providers (ISPs) and FTTH network operators. The Service provides OLT monitoring, PON network visibility, switch and port monitoring, TR-069 CPE management, smart alerting, and network topology mapping.
3. Account and Access
- Access to the NetSense NMS platform requires an active subscription agreement.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- You must notify us immediately at info@x3me.net if you suspect unauthorized access to your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to gain unauthorized access to any part of the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to transmit malware, spam, or other harmful content
- Resell, sublicense, or share access to the Service without prior written consent
5. Intellectual Property
The Service, including its software, design, logos, documentation, and content, is the intellectual property of Extreme Labs and is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.
You retain ownership of any data you upload or transmit through the Service ("Customer Data"). You grant us a limited license to process Customer Data solely to provide and improve the Service.
6. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the practices described in the Privacy Policy.
8. Subscription and Payments
- Subscription plans, pricing, and billing terms are agreed upon separately between you and Extreme Labs.
- All fees are non-refundable unless otherwise stated in your subscription agreement.
- We reserve the right to change pricing with 30 days' notice. Existing subscriptions will honor current pricing until renewal.
9. Termination
- Either party may terminate the subscription in accordance with the terms of the subscription agreement.
- We may suspend or terminate your access immediately if you violate these Terms.
- Upon termination, you may request a copy of your Customer Data within 30 days. After that period, we may delete your data.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Extreme Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid for the Service during the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Extreme Labs, its directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Bulgaria. Any disputes arising from these Terms shall be resolved by the competent courts in Sofia, Bulgaria, without prejudice to your rights under applicable consumer protection laws.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
